Selling Your Home During a Divorce in Minnesota

A calm, neutral sale when two owners need to agree, with the same information shared with both of you.

A calm, fair sale during a hard season

Selling a home during a divorce is one of the most difficult transactions there is. Two people have to agree on decisions at a time when agreeing is hard, and the home is often the largest asset you share.

I'm Lesley, a REALTOR® with Bridge Realty. When we represent a home sale during a divorce, our role is to stay neutral, keep both owners equally informed, and protect the value of the home.

How do you sell a house during a divorce in Minnesota? Both owners usually agree on an agent, a price, and how the proceeds will be handled, often with guidance from their attorneys or a mediator. The home is then prepared, listed, and sold like any other, with both owners signing the key documents.

One agent, two owners, the same information

The sale goes most smoothly when both owners trust the process. Here is how we earn that trust:

  • The same updates go to both of you, at the same time, in writing. No one hears news second.
  • Pricing comes from the market. We show you both the same recent sales, so the price is based on evidence, not on either person's opinion.
  • Decisions are documented. Price changes, offers, and repair requests are shared with both owners before anything is signed.
  • You can communicate with us separately. You do not need to be in the same room or on the same call.

Sell the home, or keep it?

Before a home is listed, many couples weigh three paths:

  • Sell and divide the proceeds. This gives each person a clean start and a clear number.
  • One person keeps the home. That usually means buying out the other person's share and refinancing the loan into one name.
  • Keep it for now and sell later. Some families wait for a set date, which requires clear agreement on who pays what in the meantime.

Each path begins with the same question: what is the home worth today? We prepare a market analysis you can both rely on. Request one on our home value page.

How property is divided is a legal question. Your attorney or mediator guides that decision, and we work alongside them.

Working with your attorneys and the timeline

A divorce sale often has deadlines and conditions that an ordinary sale does not. We coordinate with your attorneys or mediator so the listing, the price, and the closing all follow your agreement or any court order.

We also plan for the practical details early: who lives in the home during the sale, how showings are scheduled, who pays for repairs, and how the proceeds are distributed at closing. Settling these questions up front prevents conflict later.

Protecting the value of your home

During a difficult time, it is easy for a home to be neglected or underpriced for the sake of a quick exit. Both of you benefit when the home sells for its full value.

We guide you through preparing the home, presenting it well, and negotiating offers with a clear head. You can read how we prepare and market a home on our how we sell your home and selling your home pages. If either of you plans to buy afterward, our buying a home page is a good place to start.

Frequently Asked Questions

Do both spouses have to agree to sell the house in Minnesota?

In most cases, both owners must sign to sell a home they own together, unless a court orders otherwise. Your attorney can tell you what applies to your situation.

Should we sell the house before or after the divorce is final?

It depends on your finances, your agreement, and tax and legal considerations. Many couples sell during the process so the proceeds can be divided as part of the settlement. Ask your attorney and a tax professional.

Can one spouse keep the house?

Often, yes. It usually means buying out the other person's share and refinancing the mortgage into one name. A lender can tell you whether that is possible on one income.

How is the price decided if we disagree?

We show both owners the same recent sales of similar homes, so the price is based on market evidence. If you still disagree, an independent appraisal can help settle the question.

Will you keep our situation private?

Yes. The reason for a sale is not shared with buyers or their agents, and we share details only with the people who need them to complete the sale.
